Terms of service
These Terms of Service (“Terms”) apply to your use of the website at 3bg.shop (the “Site”), run by Three B Gardens LLC, a Florida limited liability company (“Three B Gardens,” “we,” “us,” or “our”), based in Cape Coral, Florida. By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. The Site is a catalog
The Site lets you browse our dry goods (pots, kits, Trop Mix blends and supplies). We do not sell live plants on the Site; our live plants are sold separately through live plant auctions on Whatnot and on Palm Street, under those platforms’ terms. You can’t check out on the Site right now: product pages link to Whatnot or Palm Street, and any purchase you make there is a contract made on that platform, subject to that platform’s terms, policies and checkout, as well as our Shipping Policy and Refund Policy. Purchases are covered by any buyer protection the platform offers (for example, Whatnot Buyer Protection or Palm Street’s Late Delivery Protection), under that platform’s terms.

All sales are final, except as described below.
Damaged, defective or wrong items. Our products are sold and paid for on Whatnot or Palm Street, so we handle problems through that platform. If your order arrives damaged or defective, or isn't what you bought, use the order's help option in the app or message us there as soon as you can, within that platform's reporting deadline. Include clear photos of the item, the packaging and the shipping label. We'll make it right with a replacement if we have one and you agree, or a full or partial refund to your original payment method. You only get a partial refund if you accept it. If we can't resolve it together, you can escalate to Whatnot or Palm Street support. Nothing in this policy limits your rights under Whatnot's or Palm Street's buyer protection or under applicable law. Live plants are sold only on Whatnot and Palm Street and follow those platforms' plant policies.
If you can’t reach us in the app, email hello@threebgardens.com and we’ll continue your case in the platform’s messages. We don’t settle orders outside the platform. See our Refund Policy.
2. Using the Site
- Please don’t use the Site for anything illegal, try to hack or disrupt it, or copy or scrape its content.
- If you send us information through the contact form or by email, please make sure it’s accurate.
3. Our products
- We try hard to describe and photograph our products accurately. Our pots and covers are 3D-printed in-house and Trop Mix is made from natural materials, so color, texture and finish may vary a little from the photos and from batch to batch.
- Prices, options and availability shown on the Site are for information and can change. The price and availability shown at checkout on Whatnot or Palm Street are what apply.
- Growing results depend on many things outside our control (light, water, climate, plant care). We can’t guarantee any specific growing results from our products.
- Soil and potting mixes are for horticultural use only. Keep them away from children and pets, and don’t eat them. Wear gloves and avoid breathing in dust when handling, and wash your hands after use.
4. Intellectual property
Everything on the Site, including our name, logo, product names (such as Trop Mix and Corm Condo), photos, text and pot designs, belongs to Three B Gardens or our licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.
5. Third-party links and services
The Site runs on Shopify and links to other websites, including Whatnot, Palm Street, TikTok and Instagram. The Site is hosted by Shopify, which collects and processes personal information about visitors as described in our Privacy Policy. We aren’t responsible for third-party sites or services, and your use of them is subject to their own terms.
6. Disclaimer
Except as stated in our policies or required by law, the Site and its content are provided “as is” and “as available.” Nothing in these Terms limits any rights you have under applicable law or under the buyer protection of the platform you purchased on.
7. Limitation of liability
To the fullest extent the law allows, Three B Gardens and its owners, family members and staff are not liable for any indirect, incidental, special or consequential damages arising from your use of the Site. Some states don’t allow certain limitations, so some of these may not apply to you.
8. Indemnification
You agree to hold Three B Gardens harmless from any claims, losses or expenses (including reasonable attorneys’ fees) that arise from your breaking these Terms or misusing the Site.
9. Governing law
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. If a problem comes up, please email us first.
10. Privacy
Our Privacy Policy explains how we handle personal information and is part of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. Changes take effect when they’re posted on the Site, and the “Last updated” date will change.
12. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce a right right away, we don’t give it up.
